Terms and Conditions

These Terms govern access to public profiles, links, reporting tools, and the private analytics dashboard operated by Nomis IT.

1. Acceptance and scope

By accessing or using the Service, you agree to these Terms and the Privacy Policy. If you act for a company, creator, or another person, you confirm that you have authority to bind them. If you do not agree, do not use the Service.

The Service is operated by Nomis IT, a French single-member limited liability company (SARL à associé unique) with share capital of 1,000 EUR, registered under RCS Lille Métropole 921 726 170 · SIREN 921 726 170 · EUID FR5910.921726170, with registered office at 2 ter rue d’Anchin, 59242 Templeuve-en-Pévèle, France. Simon Brienne is its legal representative and director of publication. Hosting is provided by Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, United States.

2. Definitions

Content means text, images, profile information, links, reports, and other material submitted to or displayed by the Service. Profile Operator means the person or organisation responsible for a profile. Visitor means anyone viewing a public profile or following a link. Service means the public profiles, tracked redirects, reporting function, and private dashboard available through https://akirabbyy.com.

3. Eligibility and adult use

You must be at least 18 years old and legally capable of agreeing to these Terms. The Service is not directed to minors. Profile Operators are responsible for any additional age checks required by the content or third-party destinations they choose to link.

4. Access and operator credentials

Visitors do not create accounts on the public pages. Authorized operators may receive access to a private dashboard. They must keep credentials confidential, use them only for the authorised purpose, and tell Nomis IT promptly about suspected loss, disclosure, or unauthorised use. We may require a credential to be replaced.

5. Privacy

The Privacy Policy describes the information processed by the Service, optional analytics consent, report data, browser storage, retention, and rights. By using the Service, you acknowledge that Policy.

6. Limited right to use the Service

Subject to these Terms, Nomis IT grants you a limited, personal, non-exclusive, non-transferable, revocable right to access the Service for its intended purpose. You may not copy, sell, sublicense, reverse engineer, bypass access controls, or exploit the Service except where applicable law expressly permits it.

7. Content ownership and licence

Profile Operators retain ownership of Content they provide. They grant Nomis IT a worldwide, non-exclusive, royalty-free licence, for as long as needed to operate the profile, to host, cache, reproduce, adapt for display, transmit, secure, moderate, and make that Content available through the Service. This licence ends when the Content is deleted, except for reasonable backups and material retained for legal reasons.

8. Content promises

By providing Content, a Profile Operator confirms that it is accurate where presented as factual, that they own it or have all necessary permissions, and that its publication and linked destinations do not violate law, contract, privacy, publicity, intellectual-property, or other rights. They remain responsible for the Content and for permissions relating to any person shown in it.

9. Restricted Content and conduct

You may not use the Service for:

  • content involving the sexual abuse or exploitation of minors, grooming, or solicitation of minors;
  • non-consensual intimate imagery, sexual exploitation, trafficking, coercion, or threats;
  • harassment, credible threats, hate speech, unlawful discrimination, or encouragement of violence;
  • impersonation, fraud, phishing, scams, malicious software, deceptive links, spam, or unlawful goods and services;
  • infringement of copyright, trademark, privacy, publicity, confidentiality, or other rights;
  • attempts to disrupt, probe, scrape protected data, overload, bypass, or gain unauthorised access to the Service;
  • any activity that violates applicable law or exposes another person to material harm.

10. Child safety standards

Sexual content involving or targeting minors is prohibited without exception. We may immediately disable access, preserve relevant evidence where lawful, and report suspected child sexual abuse material or exploitation to competent authorities and specialist organisations. A person reporting an urgent risk should also contact local authorities.

11. Content availability and backups

We take reasonable steps to operate the Service, but Content may be changed, unavailable, or lost. Profile Operators should keep their own copies of images, text, link configurations, and evidence. The Service is not a backup or permanent archive.

12. Reports, moderation, and appeals

Anyone may use Report to flag content or links. We may review a report, seek clarification, preserve evidence, restrict or remove a link or profile, suspend dashboard access, notify a Profile Operator, or refer a matter to authorities. We may prioritise reports involving minors, non-consensual imagery, exploitation, or imminent harm. To challenge a moderation decision or provide more evidence, contact contact@nomis-it.com and include the report reference where available.

13. Copyright and intellectual-property notices

A rights holder or authorised representative may send a notice to contact@nomis-it.com. It should identify the protected work or right, identify the profile or URL concerned, explain the alleged infringement, provide contact details, include a good-faith statement that the use is not authorised, confirm the notice is accurate, and include the sender’s physical or electronic signature. We may forward relevant parts to the Profile Operator and may reject incomplete or abusive notices.

14. Our intellectual property

The Service’s software, interface, branding, original design, text, databases, and related rights belong to Nomis IT or its licensors. These Terms do not transfer ownership or permit use of names, marks, or branding except with prior written permission. Third-party marks remain the property of their owners.

15. Feedback

If you voluntarily provide an idea or suggestion about the Service, you permit Nomis IT to use it without restriction or payment, provided that this does not transfer ownership of unrelated confidential information or Personal Data.

16. Purchases, subscriptions, promotions, and ambassador programmes

The Service itself currently sells no visitor subscription, in-app purchase, paid promotion, or ambassador programme. A third-party destination may offer products or subscriptions under its own contract, pricing, refund rules, and payment processing. Nomis IT is not the seller of those third-party offerings merely because a profile links to them.

17. Third-party links and services

Links are selected by Profile Operators and lead to services not controlled by Nomis IT. We do not guarantee or endorse their content, availability, security, age controls, pricing, transactions, or privacy practices. Your relationship with a destination is governed by that destination’s terms. Check the URL and destination before sharing information or paying.

18. External APIs and social integrations

The Service currently does not use YouTube API Services, social-login APIs, contact-upload APIs, or connected social-network analytics. If such a feature is introduced, the applicable third-party terms and notices will be added before use.

19. Suspension and termination

We may restrict, suspend, or end access immediately where reasonably necessary for safety, security, legal compliance, non-payment under a separate operator agreement, prolonged inactivity, or breach of these Terms. A Profile Operator may request closure by contacting contact@nomis-it.com. Provisions concerning rights, licences already exercised, reports, liability, indemnity, disputes, and legal retention survive where their nature requires.

20. “As available” disclaimer

The Service is provided on an “as available” basis. To the fullest extent allowed by law, we do not promise uninterrupted access, error-free operation, permanent storage, a particular analytics result, sales, audience attribution, or the safety and availability of a third-party destination. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

21. Limitation of liability

To the fullest extent permitted by applicable law, Nomis IT is not liable for indirect or consequential loss, lost profit, lost opportunity, loss caused by a third-party destination, or loss caused by Content supplied by a Profile Operator. For professional users, aggregate liability arising from the Service will not exceed the amount paid to Nomis IT for the affected Service during the twelve months before the event giving rise to the claim; where no amount was paid, the cap is 100 EUR. This cap does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or liability that cannot legally be limited.

22. Indemnification by professional operators

To the extent permitted by law, a Profile Operator acting for professional purposes will indemnify Nomis IT against third-party claims, reasonable costs, and losses resulting from their unlawful Content, destination links, lack of required permissions, or material breach of these Terms. This provision does not apply to consumers where prohibited by law.

23. Governing law and disputes

These Terms are governed by French law. Before filing a claim, contact contact@nomis-it.com so the parties can try to resolve it informally. If you are a consumer in the European Union, mandatory protections and the courts available under the law of your habitual residence remain unaffected. For disputes between professionals, the competent courts of Lille Métropole have exclusive jurisdiction unless mandatory law provides otherwise.

24. Legal compliance and trade restrictions

You may not use the Service where doing so would violate applicable sanctions, export controls, or other trade restrictions. You represent that you are not prohibited by applicable law from receiving the Service.

25. Severability and waiver

If a provision is found invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision once is not a waiver of that provision or any later breach.

26. Translation and changes

An English version is provided for the current Service. If a translation conflicts with this version, the version designated in the applicable operator agreement or, absent such designation, this English version controls to the extent permitted by law. We may revise these Terms and will publish the new date here. Continued use after a change takes effect means acceptance where the law permits; additional notice or consent will be obtained where required.
